Modern Fitness – Terms and Conditions

These Terms and Conditions govern your purchase from Modern Fitness (Modern Group Ltd) and ensure you are clear on your rights and obligations.

1. General

  • Unless otherwise stated, all items carry a 12-month warranty from the date of delivery.

  • Some products “where explicitly stated carry a LIFETIME warranty.

  • Modern Fitness offers durable, quality products at competitive prices.

  • By purchasing from us, you agree to these Terms and Conditions.

2. Standard Warranty

  • The warranty covers manufacturing faults only and cannot exceed the value of the original purchase.

  • It does not cover:

    • Routine maintenance.

    • Costs of removal or reinstallation.

    • Loss of time, earnings, or consequential loss.

    • Damage from misuse, improper maintenance, or accidental dropping.

    • Wear and tear or cosmetic changes unrelated to function.

  • Maintenance (such as checking and tightening screws/bolts) is the responsibility of the buyer. Regular checks should be performed, especially for products with moving parts.

  • If a part is faulty, we may supply a replacement part for you to fit, or arrange collection and repair as appropriate. We do not provide on-site engineers or installations.

3. Delivery

  • Pilates Reformers are delivered in sturdy wooden crates, doorstep only (driver cannot assist with bringing the product inside).

  • Contact us prior to purchase if you require inside delivery.

  • Take care when opening crates; sharp edges may be present.

  • Retain the original crate until fully satisfied with your purchase; if you return a Reformer without its original crate, £100 will be deducted from your refund to cover crate replacement.

4. Inspection and Damage Reporting

  • Inspect your item for damage within 24 hours of delivery.

  • Report any damage in writing within 48 hours from receipt.

  • Do NOT install or use the equipment if you are not fully satisfied with its condition.

  • Claims relating to damage will not be accepted after installation or use.

5. Returns and Refunds

  • If you are unhappy with your purchase, do not use it. We offer a 100% satisfaction money-back guarantee.

  • To be eligible for a refund or replacement, items must be returned unused and in their original packaging at your own cost.

  • Any refund for Pilates Reformers not returned in their original crate will be subject to a £100 deduction.

6. Bespoke Orders

  • “Bespoke” items are those made or sourced to your specifications.

  • Please ensure specifications for bespoke items are accurate and suitable.

  • Returns are not accepted for bespoke items unless faulty.

  • No warranty is given as to the suitability of bespoke items for your needs.

7. Liability

  • Modern Fitness makes no guarantees as to the suitability of any product for your individual needs or fitness routine.

  • It is your responsibility to ensure products are suitable and used safely.

  • We will not accept responsibility for injuries sustained while using our products.

  • The guarantee does not cover products improperly used, neglected, or modified by the user.

8. Specification Changes

  • Minor changes in specification, size, or colour tone may occur. These do not affect the product’s core function and are not grounds for return.

  • It is your responsibility to check product compatibility and suitability prior to assembly or use.

9. Repairs and Replacement Parts

  • If repairs are necessary, you may be required to package the item for return.

  • Modern Fitness will not reimburse costs for repairs or parts sourced independently, unless previously authorised.

10. Statutory Rights

  • These Terms do not affect your statutory rights under UK law.
